Aisleify Terms of Service
Effective date: October 10, 2026
The short version
This summary is here to help you read the Terms. It isn't part of the legal agreement; the full sections below are what count.
- Aisleify is a tool for grocery store owners and staff to design their own sale ads. It's for business use by adults (18+).
- You own the ads you create. We only get the permission we need to store, show and process them for you.
- You're responsible for what you upload and what your ads say, including prices, product images and logos.
- Aisleify is free during early access. We may add paid plans later, but we'll never charge you without telling you first and getting your agreement.
- The app is provided "as is." We may change features, and we may suspend or close accounts.
- You can delete your account at any time from inside the app. That erases your ads, files and data.
- California law applies.
1. About these Terms
These Terms of Service ("Terms") are an agreement between you and Aisleify ("Aisleify," "we," "us"). They cover your use of the Aisleify website, web app and related services (together, the "Service").
By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you don't agree, please don't use the Service.
If you're using Aisleify for a business (which is what it's for), you confirm that you have authority to accept these Terms for that business. In that case, "you" means both you and the business.
2. Who can use Aisleify
To use the Service, you must:
- be at least 18 years old;
- use the Service for business purposes, such as creating ads and promotional materials for a store; and
- not be prohibited from using the Service under U.S. law, including sanctions and export laws.
3. Where Aisleify is offered
Aisleify is operated from California, USA, and is intended for businesses in the United States. If you use it from somewhere else, you do so on your own initiative and are responsible for following your local laws.
4. Your account
- Accurate info. Give us accurate sign-up information and keep your email address current. We use it to reach you about your account.
- Keep it secure. You're responsible for keeping your login details safe and for everything that happens under your account. Tell us right away at contact@aisleify.com if you think someone has accessed your account without permission.
- Signing in with Google. If you sign in with Google, Google's own terms also apply to that sign-in. We never see your Google password.
- Your account is yours. Don't sell, rent or transfer your account to anyone else.
5. Early access, free use, and future paid plans
- Free during early access. Aisleify is currently free to use while in early access.
- Early access means things may change. Features may be unfinished, change often, or have bugs. Keep your own copies of anything important.
- Usage limits. We may set reasonable limits on how much you can use certain features, such as AI features, image search or background removal. We may change these limits over time.
- Future paid plans. We reserve the right to introduce paid plans, charge for some or all features, or change what's included in the free version. We won't charge you anything unless you first see the price and agree to pay it. If we introduce paid plans, the billing terms (renewals, cancellations, refunds) will be shown to you before you buy.
6. Your content — you own it
"Your Content" means everything you upload or create in Aisleify: your ads and designs, photos, logos, product images, text, and any files you add.
You own Your Content. Aisleify doesn't claim ownership of your ads or anything you upload. You can download your finished ads and use them however you like, in print, online, in your store or anywhere else, subject to the rights of others (see Section 8).
7. The limited permission you give us
To run the Service for you, we need your permission to handle Your Content. You grant Aisleify a limited, non-exclusive, royalty-free license to host, store, copy, display, process and transmit Your Content only as needed to:
- provide the Service to you, for example saving your designs, showing them back to you, generating previews and downloads, and running features you choose, like background removal or AI tools;
- keep the Service secure and working properly; and
- comply with the law and enforce these Terms.
This license:
- only lets us act for you. We won't use your ads to advertise Aisleify or sell them to anyone without your permission;
- covers our service providers (listed in our Privacy Policy) only to the extent they need it to help us run the Service for you; and
- ends when you delete the content or your account. The only exceptions are the brief period it takes for deleted data to clear from our systems and backups, and anything we must keep by law.
8. You're responsible for your content and your ads
You are solely responsible for Your Content and for how you use your finished ads. By uploading or creating content, you promise that:
- You have the rights. You own Your Content or have permission to use it, including any photos, logos, brand names, product packaging or artwork.
- Many grocery ads show branded products. Following any rules from those brands or suppliers about using their logos and product images is your responsibility.
- Your ads are accurate and lawful. Prices, sale dates, discounts, quantity limits and other claims in your ads are correct and comply with all advertising, pricing and consumer-protection laws that apply to you. Aisleify doesn't check your ads for accuracy or legal compliance.
- You respect other people. You have permission to show any recognizable person in your ads, and your content doesn't violate anyone's privacy, publicity or other rights.
- If your ads collect information. If you publish ads or materials that collect personal information from shoppers (for example, a sign-up QR code you add), you're responsible for complying with privacy laws for that information.
We may, but don't have to, review, remove or disable any content that we believe breaks these Terms or the law, or that could harm Aisleify or others.
9. Rules for using Aisleify
Please don't:
- upload or create anything illegal, fraudulent, deceptive, hateful, harassing, sexually explicit or violent;
- create false or misleading ads, such as fake prices, bait-and-switch offers, or fake endorsements;
- infringe anyone's copyright, trademark or other rights;
- upload viruses or malicious code, or try to hack, overload or disrupt the Service;
- try to access other users' accounts or data, or areas of the Service you aren't authorized to use;
- scrape, copy or harvest data or content from the Service by automated means;
- reverse-engineer the Service or copy its features, design or code to build a competing product;
- use the Service to train or improve an AI model or another product;
- get around usage limits, security features or any future payment requirements; or
- resell, sublicense or give others access to the Service itself (as opposed to the ads you make with it) without our written permission.
10. AI features
Some features use artificial intelligence (provided by Anthropic) to help you create content, for example by suggesting text.
- Check everything. AI output can be wrong, incomplete or unexpected. It may get prices, product names or other details wrong. You're responsible for reviewing and correcting AI output before you use it.
- Not unique. AI may produce similar output for other users. We don't guarantee that AI output is unique or that it can be protected by copyright.
- Ownership. As between you and Aisleify, AI output you create in your account is part of Your Content.
- Your inputs. Don't put anything into AI features that you don't have the right to use, and avoid entering sensitive personal information.
11. Third-party services and content
The Service relies on outside providers, and some features connect you to them directly:
Stock photos (Pexels). Product image search is powered by Pexels. Photos from Pexels are subject to the Pexels license, which you must follow. Among other things, you may not:
- use a photo in a way that suggests a person or brand endorses your store;
- show identifiable people in a negative or offensive way;
- sell unedited copies of a photo; or
- use a photo as a logo or trademark.
We don't own these photos and don't guarantee they're free of third-party rights, such as brands visible in a photo.
Background removal (remove.bg). Images you choose to process are sent to remove.bg.
Sign-in (Google). Optional sign-in through Google.
These providers have their own terms and privacy policies. We're not responsible for their services, content or practices, and a provider may change or stop its service, which could affect features in Aisleify.
12. Aisleify's own property, and your feedback
- Our stuff. The Service itself belongs to Aisleify or our licensors, protected by intellectual property laws. That includes our software, design, templates, graphics, name and logo. Subject to these Terms, we give you a personal, non-transferable, revocable right to use the Service for your business. You may use any templates or design elements we provide as part of the ads you make in Aisleify, but you may not extract and redistribute them on their own.
- Feedback. If you send us ideas or suggestions, we may use them freely to improve Aisleify, without owing you anything. We appreciate them!
13. Copyright complaints (DMCA policy)
We respect copyrights and expect our users to do the same. We respond to copyright complaints under the U.S. Digital Millennium Copyright Act ("DMCA").
13.1 Reporting copyright infringement
If you believe content in Aisleify infringes your copyright, send a written notice to our Copyright Agent (contact details in Section 13.5). Your notice must include:
- your physical or electronic signature (typing your full name works);
- a description of the copyrighted work you believe was infringed (or, for several works, a representative list);
- a description of the material you believe is infringing and enough information for us to find it, such as a link or a description of the ad and account;
- your contact information: name, mailing address, phone number and email;
- a statement that you have a good-faith belief the use isn't authorized by the copyright owner, its agent, or the law; and
- a statement that the information in your notice is accurate, and, under penalty of perjury, that you are the copyright owner or authorized to act for the owner.
Notices missing these elements may not be processed.
13.2 What happens next
When we receive a valid notice, we will:
- promptly remove or disable access to the material;
- notify the user who posted it and, where appropriate, give them a copy of the notice; and
- keep a record of the notice.
13.3 Counter-notices (if your content was removed by mistake)
If your content was removed and you believe it was a mistake or misidentification, you can send our Copyright Agent a counter-notice that includes:
- your physical or electronic signature;
- a description of the material that was removed and where it appeared before removal;
- a statement, under penalty of perjury, that you have a good-faith belief the material was removed by mistake or misidentification;
- your name, address and phone number; and
- a statement that you consent to the jurisdiction of the federal district court for your address (or, if you're outside the U.S., any judicial district where Aisleify may be found), and that you'll accept service of legal papers from the person who sent the original notice or their agent.
When we receive a valid counter-notice, we'll send a copy to the person who sent the original notice. If they don't tell us within 10 business days that they've filed a court action to stop the infringement, we may restore the material 10 to 14 business days after receiving the counter-notice.
13.4 Repeat infringers
We will close the accounts of users who repeatedly infringe copyrights, in appropriate circumstances. As a general rule, an account that receives 3 valid copyright complaints within 12 months may be terminated. Complaints successfully challenged by counter-notice don't count. We may also close an account after a single complaint if the infringement is serious or obvious.
13.5 Our Copyright Agent
Copyright Agent, Aisleify
Email: contact@aisleify.com (subject line: "DMCA Notice")
13.6 Please don't file false claims
Under the DMCA, anyone who knowingly makes a false statement in a notice or counter-notice may be liable for damages, including legal costs. Before sending a notice, consider whether the use could be permitted, for example under fair use. If you're not sure, talk to a lawyer.
13.7 Trademarks and other rights
For complaints about trademarks or other rights, email contact@aisleify.com with details. We'll review them and may remove content that we believe violates these Terms.
14. Changes to the Service
Aisleify is growing and will change. We may add, change, limit or remove features, change usage limits, or stop offering the Service (or any part of it) at any time. If we decide to shut down the Service completely, we'll try to give you reasonable notice so you can download your ads.
15. Suspension, termination, and deleting your account
You can leave any time. You can delete your account from inside the app at any time. Deleting your account permanently erases your ads, files and data, as described in our Privacy Policy. Download anything you want to keep first; deleted content can't be recovered.
We can suspend or close accounts. We may suspend or terminate your account, or your access to all or part of the Service, at any time, including (for example) if:
- you break these Terms or the law;
- your use creates risk or possible legal exposure for Aisleify or others;
- we're required to by law; or
- we stop offering the Service.
When we close an account that hasn't broken the rules, we'll try, where reasonable, to give you advance notice so you can download your ads. We may act without notice when there's a violation, a legal requirement, or a risk to the Service or other users.
What happens after. When your account ends, your right to use the Service stops, and we may delete your account and Your Content. Sections that by their nature should continue will survive: for example, Sections 8, 12, 13.6, 16, 17, 18, 19 and 21.
16. Disclaimers
The Service is provided "as is" and "as available," without warranties of any kind, whether express, implied or statutory. To the fullest extent allowed by law, Aisleify disclaims all warranties, including any warranties of merchantability, fitness for a particular purpose, title, non-infringement, and any warranties arising from course of dealing or usage of trade.
We don't promise that:
- the Service will be uninterrupted, secure or error-free;
- your content will never be lost; keep your own copies of important ads;
- AI output, stock photos or other content will be accurate, lawful or suitable for your purpose; or
- ads made with Aisleify will produce any particular business results.
Some places don't allow certain warranty disclaimers, so some of the above may not apply to you.
17. Limitation of liability
To the fullest extent allowed by law:
- No indirect damages. Aisleify and its owners, employees, contractors and service providers will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages. That includes lost profits, lost revenue, lost sales, lost data, business interruption or loss of goodwill, even if we were told they were possible.
- Cap on liability. Our total liability for all claims relating to the Service or these Terms is limited to the greater of (a) US $100 or (b) the amount you paid Aisleify in the 12 months before the event giving rise to the claim.
These limits apply whatever the legal theory (contract, negligence, or anything else). They don't limit liability that can't be limited by law, such as liability for fraud or willful misconduct.
18. You'll cover us if your content or conduct causes a claim (indemnification)
To the fullest extent allowed by law, you agree to defend, indemnify and hold harmless Aisleify and its owners, employees, contractors and service providers from any claims, damages, losses, liabilities, costs and expenses, including reasonable attorneys' fees, arising from:
- Your Content, including your ads and anything you upload;
- your use of the Service or of the ads you create;
- your breach of these Terms; or
- your violation of any law or anyone else's rights, including intellectual property, advertising and privacy rights.
We may choose to control the defense of any such claim, and you'll cooperate with us. You won't settle a claim that affects Aisleify without our written consent.
19. Disputes
19.1 Talk to us first
Most problems can be solved with a conversation. Before starting any formal legal claim, please email contact@aisleify.com with a description of the issue and what you'd like us to do. Both sides agree to try in good faith to resolve it informally for 60 days. Time limits for bringing claims pause during this period.
19.2 Governing law
These Terms and any dispute between you and Aisleify are governed by the laws of the State of California, USA, without regard to its conflict-of-law rules.
19.3 Courts in California
Any dispute that isn't resolved informally will be decided exclusively in the state courts located in Tulare County, California, or the federal courts for the district that includes Tulare County. You and Aisleify both agree to the jurisdiction of those courts. Either side may still bring an individual claim in small claims court if it qualifies.
19.4 Time limit for claims
To the extent allowed by law, any claim relating to the Service or these Terms must be brought within one year after it arises, or it's permanently barred.
20. Changes to these Terms
We may update these Terms from time to time. When we do, we'll post the new version and update the "Effective date" at the top. If a change is significant, we'll give you reasonable advance notice by email or in the app. If you keep using the Service after the changes take effect, you accept the new Terms. If you don't agree, please stop using the Service and delete your account. Changes won't apply to disputes that arose before the change was posted.
21. General legal terms
- Entire agreement. These Terms, together with our Privacy Policy and any terms shown to you for a specific feature or plan, are the whole agreement between you and Aisleify about the Service.
- Severability. If any part of these Terms is found unenforceable, it will be limited as little as needed, and the rest stays in effect.
- No waiver. If we don't enforce a part of these Terms right away, we haven't given up the right to enforce it later.
- Assignment. You may not transfer these Terms or your account without our written consent. We may transfer them, for example in a merger, acquisition, sale of assets or reorganization, including to the Aisleify LLC once it is formed.
- Events beyond our control. We're not responsible for delays or failures caused by events outside our reasonable control, such as outages at our hosting or service providers, internet failures, natural disasters, or government action.
- Notices. We may send you notices by email to the address on your account or through the app. You can send notices to contact@aisleify.com.
- Export and sanctions. You may not use the Service in violation of U.S. export or sanctions laws.
- Relationship. These Terms don't create any partnership, employment or agency relationship between you and Aisleify.
- Headings and examples. Headings and the summary at the top are for convenience only. Words like "including" and "for example" mean "including, without limitation."
